Lawmakers Battle over Impact of American Health Care Act on Vets

According to a May 5 Military.com post by Richard Sisk, HVAC Chair Phil Roe (R-TN) insisted that the health-care bill narrowly passed by the House last week would not affect tax credits for veterans who are not currently enrolled in VA health care. Democratic legislators say it would because language on the tax credits was left out of the proposed legislation.

VA Telehealth Affected by Physician Licensure Rules

According to a May 8 Federal News Radio report by Jared Serbu, most of VA’s services connect a doctor at one VA facility with a patient at another one. That’s perfectly legal, as long as the doctor has an unrestricted license in at least one state. But the rules are different if the patient is not on federal property–say, at home or at a private-sector medical clinic. In that case, the VA clinician would have to be licensed in the state where the patient happens to be sitting.

VA Whistleblower Retaliation Claims Stir Up Congressional Ire

According to a May 9 report by Malia Zimmerman for Fox News, Sen. Ron Johnson (R-WI) said, “There is no excuse for retaliation against VA whistle-blowers like Dr. Klein. The president’s recent executive order makes that abundantly clear. The VA should fully comply with the committee’s request and stop the retaliation against Dr. Klein, who was only trying to expose substandard patient care.”

VA Issues Short-term Extension Review of Caregivers Program

The VA has announced a six-week extension for the strategic review of its Program of Comprehensive Assistance for Family Caregivers. On April 17, the VA announced its decision to temporarily halt certain revocations because of concerns about the inconsistent application of eligibility requirements throughout its medical centers. VA will use the six-week extension to establish clear guidance on enrollment criteria for the program.

VA Call for Accountability Legislation in Wake of Federal Appeals Ruling

The VA announced on May 8 that the U.S. Court of Appeals for the Federal Circuit in Helman v. Department of Veterans Affairs ruled as unconstitutional the expedited Senior Executive Service removal and appeals authority provided by the Veterans Access, Choice, and Accountability Act of 2014. As a result of this ruling, the Merit Systems Protection Board has been directed to review the administrative judge’s decision upholding VA’s November 2014 removal of the director of the Phoenix VA Healthcare System. The former director’s removal remains in effect at this time.
